Introduction  

1.1 These T&Cs constitute a legally binding agreement between CAP Ltd and the homeowner or short or long term rental client. The San Andres Golf website is only associated with CAP Ltd, whose UK Company Registration No is 07008249.

1.2  The San Andres Golf website is both a source of local information and reference for local residents and visitors to the area and an on-line platform for property owners to have their property listed for short term rent [CAP Ltd commission is 12.5%], for long term rental [CAP Ltd commission is 7.5%] or for sale [CAP Ltd commission is 3%, only to the buyer] and for short or long term clients to book or purchase such properties [no commission is charged].   For short term rental clients booking payments can be made in two or three stages by bank transfer direct to the owners account [with the possibility of a percentage paid on arrival] or by credit card via a third party payment provider which attracts a 3% charge to cover the costs of this facility. Payments and charges are always expressed in euros.

1.3 These terms and conditions establish the relationship between the San Andres Golf website and anyone [owners or property managers]  who wishes to offer or list any property for sale or for short or longterm rental.

1.4 Anyone who uses the site as an individual or representing a company or other legal entity agrees to these T&Cs and is deemed to have the authority to bind that company or other legal entity to these T&Cs.

1.5 Only those persons able to enter into legally binding contracts can use the San Andres Golf website;  for short term rental clients the minimum age for the person making the booking is 28.

1.6 CAP Ltd may revise these T&Cs from time to time for reasons due to a change in applicable laws. You will be provided with 30-day’s notice in advance of
changes to any of the terms of these T&Cs or our decision to terminate them. We will inform you by email of any such changes.

1.7 The San Andres Golf website will not be participant to any acts of discrimination (including but not limited to race, ethnicity, religion, national origin, disability, sex, gender identity or sexual orientation), harassment, or violence;  any such act will result in the removal of the appropriate listing.

2. The San Andres Golf website

2.1 The site is both a showcase for the local area and a vehicle for owners to either rent their property [short or long term] or to promote their property for sale.

2.2 It is the responsibility of the property owners to comply with all local laws and comunidad regulations [to include complying with the requirements of a licence for short or long term rentals and having obtained the appropriate documentation for properties to be promoted as for sale].

2.3 Should an owner wish to rent their property on a short or long term basis whilst their property is on the market for sale then they agree with the purchaser to honour any existing bookings which may be affected in the event of a sale or to source and offer alternative suitable and equivalent accommodation for anyone who may have already paid for or reserved accommodation.

2.4 Property listings will be uploaded on to the site in accordance with information provided by the owner. It is the property owner’s responsibility to ensure there are no mistakes or omissions.

2.5 Should the property owner promote their property on one or more other websites for short term or long term rentals then it is the responsibility of the property owner to advise by email any rate changes or details of any bookings immediately so that their property calendar and pricing can be updated.   Similarly property owners will be kept informed of any potential and subsequently confirmed bookings through the San Andres Golf website.

2.6 Property owners are responsible for filing taxes and declaring their rental income.

2.7 Property owners are responsible for maintaining a high standard of cleanliness in their property, ensuring that there is adequate bedlinen, cutlery, crockery,
saucepans, plates, glasses, wine glasses, kitchen equipment, wifi, air conditioning or fans [depending on their licence criteria], sunloungers, sun umbrellas, bbqs, paelleros etc.

2.8 Rental clients will be given the opportunity to comment on their stay at a property which will be published on the website.

2.9 On behalf of the San Andres Golf website CAP Ltd maintains a privacy policy respecting and maintaining confidentiality of any sensitive information or details however homeowners agree to the forwarding of contact details, including telephone number and bank account details [if this is the preferred method of payment], name and email address where necessary in connection with a booking.

3.0 The San Andres Golf website is owned by CAP Ltd. All content appearing on the site is protected by copyright and database rights. Reproduction of any aspect of the website is prohibited.

3.1 Homeowners, where appropriate or necessary, must submit honest and current details about their personal identity, billing address, payment data, tax registration status and applicable account numbers,

3.2 Homeowners agree to release, defend, indemnify, and hold directors, employees and agents, harmless from and against any claims, liabilities, damages to their property or buildings, loss of rental income, debts, obligations, and expenses, including, without limitation, reasonable legal and/or accounting fees, arising out of or in any way related to use of the website.

3.3 Homeowners will at all times keep their property fully insured to include adequate public liability. 

3.4 If you do not agree with any part of these T&Cs, then your sole and exclusive remedy is to withdraw your property from the website.   By permitting your property to be promoted on the San Andres Golf website you will be deemed to have read, understood and agreed to theses T&Cs which shall be governed by the laws of England and Wales.buyer
